I always love it when something we discussed pops right up in the news the following week. You may have noticed this article in the New York Times today. It's all about "judicial activism:" what it means, and how much of it has been on display in the Roberts Court.
It seems that the answer Liptak is driving at here is that many of these justices are all fairly activist yet don't consider themselves to be. This is not surprising really, but I guess I assumed judges were of a mindset that included self-awareness.
